Terms + Conditions

Welcome to Ash Besse Fitness. Below are the Terms and Conditions for working with our company, and, upon signing, replaces any previous terms you may have signed in connection with our business. As a client of Ash Besse Fitness, you confirm that you are of legal age in your country to participate in our services. 

Minimum Commitment 

  • Online Coaching 

You will be required to pay for an onboarding fee prior to commencing your chosen service which covers the complete set-up, app activation & creation of programs.

Online coaching services provided by Ash Besse Fitness have a minimum 16 week commitment period. You are expected, and required to commit to this term upon signing up for your chosen service. 

If you decide to cancel during this period, you will be required to pay the 16 weeks in full. Following the minimum commitment period the contract will continue on a rolling basis unless the cancellation process is followed.

  • Face to Face Coaching or Hybrid Coaching

You may be required to pay for an onboarding fee prior to commencing your chosen service which covers the complete set-up, app activation & creation of programs.

Ash Besse Fitness have a minimum 16 week commitment period. You are expected, and required to commit to this term upon signing up for your chosen service

If you decide to cancel during this period, you will be required to pay the 16 weeks in full. Following the minimum commitment period the contract will continue on a rolling basis unless the cancellation process is followed.

Payment of Service 

  1. You will be required to pay for your services via Stripe/Newie direct debit. 

  2. You may be subject to a 3% + $0.30 transaction fee. 

  3. You may choose to pay in weekly instalments which will automate a direct debit every Monday, in advance.

  4. If a payment fails, you will be required to make payment at your first convenience. If you do not, you will be at risk of your service being put on a temporary or permanent hold. 

  5. In the event of a payment failure, a dishonour fee may be applied.  The payment system will automatically try to recharge your card. 

  6. If you have any changes to your bank card, bank account or payment method, you are required to update these details via the app & let Ash Besse Fitness know immediately if there are any changes to your circumstances.

  7. We may at any time, at our discretion, adjust the cost of your online coaching at the end of your minimum commitment period. If this is to occur, we are required to provide you at least 14 days’ notice in writing to your nominated email address. This will come into effect in your next payment following the end of the notice period.

  8. Refunds are not applicable with your service.

  9. Another frequency of payment may be available however, this is to be discussed & approved prior to commencement with Ash Besse Fitness.

Additional Fees

Additional fees will be payable by you when you request the following:

  1. Upgrading to a higher package - price of upgrade package

  2. Adding additional services, outside of your current package.

  3. Online training whilst away/on holidays - online training fees will be applied to direct debit

Operational Hours

By appointment only, Monday, Tuesday, Thursday and Friday.

5am-12pm on floor

12pm - 5pm online 

Weekends not available

Session Dates/Times/Duration

Sessions are 45mins in duration. Should you require additional time with one-on-one sessions, an additional fee will be charged. Session dates and times for a calendar month are to be confirmed prior to the commencement of that month, and before the billing cycle begins. If you have a regular day and time set with your trainer, this will be deemed confirmed at the beginning of the billing cycle, unless otherwise informed in writing (via text/app) by either party.

Cancellation of your service 

  • Online Coaching 

You are required to provide 14 days notice to cancel your service. If you are within your minimum commitment period, you are to provide as much notice as possible that you would like to cancel your service at the end of the period. Cancellation notices are to be provided in writing to ash@ashbessefitness.com 

Ash Besse Fitness is understanding of exacerbating circumstances and has the authority to waive cancellation fees under suitable circumstances.  

  • Face to Face Coaching service

Ash Besse Fitness is understanding of exacerbating circumstances and has the authority to waive cancellation fees under suitable circumstances.  

  • Face-to-face session 

There will be instances where one of us is unable to make a session. The following rules will apply and are very strict:

Cancellation by Client - You must provide us with not less than 24 hours notice if you want to cancel any session. The session is to be rescheduled within the same week of the original confirmed session day and time. Failure to cancel outside of a 24hour period will result in a forfeit of your session. 

Consistent cancellations:

I am 100% committed to you as your trainer and I expect the same commitment back from you as the client. I understand situations arise, but if you cancel more than 3 times within your minimum 12 weeks, you are creating a disservice to yourself, and hindering your progress. Therefore, it does not align with my culture and values, resulting in a cancellation of your contract and personal training. I expect hard work, dedication, and consistency. These are the pillars to YOUR success. 

We understand that being unwell/sick is sometimes out of your control, but this cancellation policy is strict. 

Cancellation by Trainer - Ash Besse Fitness will endeavour to give you not less than 24 hours notice of any session that needs to be cancelled or rescheduled. Due to ambassador contracts/commitments, Ash Besse Fitness may sometimes be called away on short notice. Trainer will do her best to reschedule the session for you within the week. If we don’t give a minimum of 24 hours notice, you will be able to reschedule your session within 7 days of the original session.

Client arriving late - If you arrive up to 15 minutes late, you will be able to train for the remainder of that session, acknowledging that the session will not extend beyond its original time frame. If you have not arrived within 15 minutes of the scheduled start time, and have not alerted your Trainer, your Trainer will be entitled to assume that you are a ‘no show’ and you will forfeit the session.

Trainer arriving late - While I always endeavour to be on time for your session, if I do arrive more than 15 minutes late and both you and the trainer are unable to make more time available, you will be entitled to train for the balance of the session, and in addition receive a bonus make up session, to the equivalent of your session time.

Small Group/Buddy Training - The rules above apply to clients who train with 2 or more people. When one person can’t make it or is late to a session. In those circumstances, you will need to reconcile prepaid fees between yourselves.

Refunds & Credits

Ash Besse Fitness does not supply a refund or credit for any services and may only be applicable in the following circumstances:

  1. Permanent incapacity - supported by medical certificate; refund.

  2. Temporary incapacity - supported by medical certificate; credit.

  3. Cancellation -  of any session provided I give not less than 24 hours notice; credit (to be used within 7 days)

  4. Suspension - of any program or group session for up to 4 weeks a year provided I give not less than 7 days notice; credit

  5. No personal training refunds will be issued for any reason, including but not limited to relocation, illness, and unused sessions.

Pause Periods 

  1. Your service can be put on hold for up to 4 weeks per year - If you pause during your minimum commitment period this will extend your minimum term by that length and will not be taken out of your minimum term. 

  2. You are to provide at least 14 days notice for your service to be paused. 

  3. Pause periods are not valid in your minimum commitment period. 

  4. Your program will be put on hold, and your app access may be removed during this time period. 

  5. Should you wish to continue training and use the online package whilst on holiday, your direct debit will be changed to reflect the cost (see pricing page).

Medical Disclaimer 

  1. Upon signing up with our program, you will be required to fill in a PARQ form through our training app. If you disclose any pre-existing medical conditions and/or disability, you will be required to provide a doctor's referral. 

  2. Ash Besse Fitness will be providing you with advice, techniques and instructions on how to complete physical activities. You understand you are solely responsible for your safety and wellbeing when training. 

  3. You agree to not hold Ash Besse Fitness available for any injuries or medical conditions that may occur during your time with Ash Besse Fitness. 

  4. You understand that any advice provided to you is not medical advice, nor do they substitute for a consulting professional 

  5. You acknowledge that any nutritional advice provided by Ash Besse Fitness is general in nature and may not be tailored to your specific needs or medical conditions. For detailed nutritional guidance, you should consult a registered dietician and/or a general practitioner.

  6. You understand that we do not provide diagnosis, treatment or advice outside of our scope of work. 


Liability 

  1. We do not accept liability or any injury or illness sustained during or after our service. By using our service, you accept all risks and take responsibility for your own safety. 

  2. You understand that results are not guaranteed, and it is solely your responsibility to ensure you are following the guidance of your program to assist in achieving results.

Service Terms 

Communication 

  1. You are expected to respond in a timely manner and be polite in your communication with Ash Besse Fitness 

  2. Derogatory comments, defamation or slurs will not be tolerated and your service will be cancelled immediately. 

Check-Ins 

  1. You are expected to complete your check-in on time. If you do not, you accept that your results may be impacted. 

  2. If you do not submit your check-in on time, your check-in may be missed and reviewed in the following week. 

Intellectual Property 

  1. You understand that Ash Besse Fitness may use your videos and/or photos of the client to market and promote their service. You are not entitled to any compensation of this use. 

  2. You will gain access to educational content including but not limited to e-books, meal plans, nutrition guides, and spreadsheets. You are not permitted to copy or distribute this. If you do, your service will be cancelled immediately. 

Personal Information 

  1. You understand that your personal information will be collected and stored for the purpose of your service. Your personal information will be kept confidential and will not be shared with a third party without your consent. 

  2. Upon signing up for online coaching services, you hereby consent to being added to the email mailing list of Ash Besse Fitness. You acknowledge that you may receive promotional and informational emails from Ash Besse Fitness, and may opt-out of the mailing list at any time by following the unsubscribe link provided in the emails.
